Recommended Action: Adopt an Ordinance amending the Zoning Map on 10.91 acres from Multiple Use 3 and Open Space to Multiple Use 2 on property located on the south side of Murrieta Hot Springs Road between Via Princesa East and Calle Del Lago.

*6.              AN ORDINANCE REGARDING SPECIFIC PLAN AMENDMENT 03-148 FOR THE MURRIETA HIGHLANDS SPECIFIC PLAN

Recommended Action: Adopt an Ordinance amending the Murrieta Highlands Specific Plan Zoning Map contained in the Murrieta Highlands Specific Plan, Substantial Conformance No. 1 on approximately 27 acres from Single Family 1 (SF-1) General Plan designation to Single Family 2 (SF-2) Specific Plan designation, generally located east of Antelope Road, south of Keller Road.

*7.              RESOLUTION APPROVING FINAL TRACT MAP 30315, A 26 LOT, 111 UNIT RESIDENTIAL CONDOMINIUM MAP LOCATED NORTH OF IVY STREET, SOUTH OF JUNIPER STREET, EAST OF ADAMS AVENUE AND WEST OF JEFFERSON AND ASSOCIATED AGREEMENTS (AMBERWALK)

Recommended Action: Adopt the Resolution approving Final Tract Map 30315 and associated agreements.

*8.              RESOLUTION APPROVING FINAL TRACT MAP 31171, A 108 LOT RESIDENTIAL SUBDIVISION MAP, LOCATED NORTH OF CLINTON KEITH ROAD, EAST OF ANTELOPE ROAD, AND WEST OF MEADOWLARK LANE, AND ASSOCIATED AGREEMENTS (CLINTON KEITH-MURRIETA LP)

Recommended Action: Adopt the Resolution approving Final Tract Map 31171 and associated agreements.

*9.              RESOLUTION ACCEPTING THE OFFER OF DEDICATION  OF FLOOD CONTROL EASEMENTS WITHIN LOTS 89 AND 105 DEDICATED TO PUBLIC USE ON BEHALF OF RIVERSIDE COUNTY FLOOD CONTROL ON TRACT MAP 23329 AND WITHIN LOTS 62, 63, 74, 75, 90, 91, 102 AND 103 OF ADJACENT TRACT MAP 23051 AND GRANTING THE NECESSARY RIGHTS OF WAY FOR THE CONSTRUCTED FLOOD CONTROL FACILITIES TO RIVERSIDE COUNTY FLOOD CONTROL DISTRICT, LOCATED NORTHEAST OF NUTMEG STREET, BORDERED ON THE WEST BY INTERSTATE 15 AND EAST OF JACKSON AVENUE

Recommended Action: Adopt the Resolution accepting the Offer of Dedication of Flood Control Easements within Lots 89 and 105 dedicated to public use on behalf of Riverside County Flood Control on Tract Map 23329 and within Lots 62, 63, 74, 75, 90, 91, 102,  and 103 of adjacent Tract Map 23051 and granting the necessary rights of way for constructed flood control facilities lying therein to Riverside County Flood Control District.

*10.          REIMBURSEMENT AGREEMENT FOR THE RELOCATION OF EASTERN MUNICIPAL WATER DISTRICT FACILITIES CONFLICTING WITH THE CONSTRUCTION OF THE CORNING/JEFFERSON STORM DRAIN

Recommended Action: Approve the Reimbursement Agreement with Eastern Municipal Water District for the relocation of facilities conflicting with the construction of the Corning/Jefferson Storm Drain and authorize the Mayor to execute the document.

*11.          REIMBURSEMENT AGREEMENT WITH RANCHO CALIFORNIA WATER DISTRICT FOR WATERLINE RELOCATION WORK AS A PART OF THE JEFFERSON AVENUE IMPROVEMENT PROJECT

Recommended Action: Approve the Reimbursement Agreement with Rancho California Water District whereby the City will be reimbursed by RCWD for work performed by the City's Contractor to make modifications to RCWD water facilities as shown on the contract plans for the Jefferson Avenue Improvement Project in the amount of $402,007.

*12.          DEDICATION OF RIVERSIDE COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT EASEMENT FOR MURRIETA CREEK MDP LINE G, STAGE 2

Recommended Action: Approve the Quitclaim Deed in favor of the Riverside County Flood Control and Water Conservation District for the Murrieta Creek MDP Line G, Stage 2, and authorize the Mayor to execute the document.

*13.          AGREEMENTS FOR THE CONSTRUCTION OF WATER SYSTEM AND ROAD AND DRAINAGE IMPROVEMENTS  FOR THE PORTION OF HOOVER AVENUE ADJACENT TO THE PROPERTY FRONTAGE OF MB 8/359, PORTION OF LOT 106 (ADAMS LANDSCAPING) BORDERED ON THE WEST BY HOOVER AVENUE AND SOUTH BY ELM STREET, LYING WEST OF INTERSTATE 15 AND EAST OF MADISON AVENUE

Recommended Action: Approve the Agreements for construction of Water System and Road and Drainage Improvement for the portion of Hoover Avenue adjacent to the property frontage of MB 8/359 Portion of 106 (Adams Landscaping).

*14.          MURRIETA HOT SPRINGS ROAD MEDIAN LANDSCAPE PROJECT FUNDING ADJUSTMENT

Recommended Action: Approve the consolidation of the residual balances in the project funding categories into the construction category and approve a $30,000 increase to the project construction budget.

*15.          CONTRACT FOR DATA ENTRY SERVICES FOR THE LAND MANAGEMENT SECTION OF THE HDL PROGRAM

Recommended Action: Approve the contract with Laura Owens Consulting in an amount not to exceed $24,000 for data entry services for the land management section of the HdL program and authorize the City Manager to execute the contract.

*16.          PROPOSAL BY ARCHAEOS TO PROVIDE HISTORICAL CONSULTING SERVICES FOR THE CITY'S PLANNING DEPARTMENT

Recommended Action: Approve the proposal by Archaeos to provide historical consulting services for the City's Planning Department.

*17.          INCREASE IN BUDGET FOR TRAFFIC SAFETY GRANT

Recommended Action: Authorize an increase in the Police Department's budget of $167,047 to pay for the identified overtime, equipment, programs, and travel associated with being awarded a State of California Office of Traffic Safety (OTS) "Murrieta Safe Streets" program grant (OTS project #PT0534), a three year traffic grant to improve traffic safety in the community of Murrieta.   The $167,047 of funds is 100% reimbursable from the State of California.

PUBLIC HEARINGS

 18.            THE ORCHARD AT STONE CREEK SHOPPING CENTER PROJECT LOCATED WEST OF INTERSTATE 215, NORTH OF CLINTON KEITH ROAD,  AND EAST OF MCELWAIN ROAD

Recommended Action: That the City Council:

a)         Adopt a Resolution certifying the Final Environmental Impact Report and Statement of Overriding Findings;

b)         Approve Development Plan 03-161, Variance 04-059 and Tentative Parcel Map 32893; and

c)         Introduce an Ordinance approving Development Agreement 04-057 subject to the Findings and amended Conditions of Approval.

 19.            ADOPTION OF THE SUPPLEMENTAL LAW ENFORCEMENT SERVICES FUND (SLESF) BUDGET AND MAKING APPROPRIATIONS FOR THE 2004-2005 FISCAL YEAR

Recommended Action: Adopt a Resolution adopting the Supplemental Law Enforcement Services Fund (SLESF) budget and make appropriations for the 2004-2005 fiscal year.

 20.            DEVELOPMENT CODE AMENDMENT FOR NOTICES OF PUBLIC HEARINGS

Recommended Action: Introduce an Ordinance amending Ordinance No. 182-97, specifically Section 16.76.030 regarding posting property with an informational sign at least ten days prior to a public hearing.

 21.            RESOLUTION OF NECESSITY FOR THE ACQUISITION OF CERTAIN PROPERTY BY EMINENT DOMAIN FOR PUBLIC RIGHT OF WAY FOR THE JEFFERSON AVENUE WIDENING PROJECT (BRANDT)

Recommended Action: Adopt a Resolution of Necessity for the acquisition of certain property by eminent domain located west of Madison Avenue, south of Juniper Street, east of Jefferson Avenue, north of Los Alamos Road, Assessor's Parcel Number 949-220-006.

 22.            RESOLUTION OF NECESSITY FOR THE ACQUISITION OF CERTAIN PROPERTY BY EMINENT DOMAIN FOR PUBLIC RIGHT OF WAY FOR THE JEFFERSON AVENUE WIDENING PROJECT (ALBAUM)

Recommended Action: Adopt a Resolution of Necessity for the acquisition of certain property by eminent domain located west of Jefferson Avenue, south of Juniper Street, east of Adams Avenue, north of Ivy Street, Assessor's Parcel Numbers 906-080-005, 006.

 23.            RESOLUTION OF NECESSITY FOR THE ACQUISITION OF CERTAIN PROPERTY BY EMINENT DOMAIN FOR PUBLIC RIGHT OF WAY FOR THE JEFFERSON AVENUE WIDENING AND EXTENSION OF AUTO MALL PARKWAY PROJECT (SMITH)

Recommended Action: Adopt a Resolution of Necessity for the acquisition of certain property by eminent domain located west of Hobie Circle, south of Date Street, east of Jefferson Avenue, north of Buecking Drive, Assessor's Parcel Number 910-262-031.

Recommended Action: Provide staff with the name(s) of a possible candidate to fill the one seat as a City appointee to Murrieta County Water District's Blue Ribbon Committee to address a possible merger.

 25.            DISCUSS REVIEW AND/OR MODIFICATION OF CITY MANAGER CONTRACT

Recommended Action: Discuss potential modifications to the contract with the City Manager.

Recommended Action: Accept the landscape improvements for Lot D of Parcel Map 30001, Arboretum, and direct the Murrieta Community Services District to commence maintenance of the landscape associated with these parcels and recordation of appropriate documents.
