Recommended Action: Adopt the Resolution approving Final Tract Map 28533-10 and associated  agreements.

*10.          AUTHORIZE EXECUTION OF A QUITCLAIM DEED TO RANCON OPPORTUNITY FUND, LLC FINALIZING TERMINATION OF A GRANT OF DRAINAGE EASEMENT

Recommended Action: Authorize the Mayor and City Clerk to execute a Quitclaim Deed to terminate a grant of easement for previously required Conditions Nos. 21 and 22 of Parcel Map 30059, which were deleted by Council action on November 18, 2003.

*11.          AMENDMENTS TO PERMA JOINT POWERS AGREEMENT

Recommended Action: That the City Council:

a)         Adopt a Resolution approving the amendment to Article 19 (c) of the Amended and Restated Joint Powers Agreement (JPA) of the Public Entities Risk Management Authority (PERMA), increasing the notice requirement for member withdrawal from a coverage program from ninety (90) days to six (6) months and vesting the Executive Committee with the authority to assess an early-withdrawal charge to a member who does not provide the required six-month notice; and

b)         Adopt the Resolution approving the amendments to Articles 8 (d), 10, 11, and 22 of the Amended and Restated Joint Powers Agreement to conform the JPA to the bylaws and current practice.

*12.          GRANT AGREEMENT BETWEEN THE CALIFORNIA STATE LIBRARY AND THE CITY OF MURRIETA

Recommended Action: Approve the Grant Agreement between the California State Library and the City of Murrieta.

*13.          FUNDING ADJUSTMENT FOR JEFFERSON AVENUE, MURRIETA HOT SPRINGS ROAD TO JUNIPER STREET

Recommended Action: Approve the revised project budget and project scope for Jefferson Avenue improvements from Murrieta Hot Springs Road to Juniper Street.

*14.          UPDATED LEGISLATIVE AGENDA

Recommended Action: Adopt the updated legislative agenda.

PUBLIC HEARINGS

 15.            DEVELOPMENT CODE UPDATE - CONTINUED PUBLIC HEARING

Recommended Action: Adopt a Negative Declaration and Introduce an Ordinance incorporating the Planning Commission's recommended Development Code amendments.

 16.            GENERAL PLAN AMENDMENT 03-223, ZONE CHANGE 03-222 AND DEVELOPMENT PLAN PERMIT 02-396 FOR THE PROPERTY SOUTH OF MURRIETA HOT SPRINGS ROAD ON THE WEST SIDE OF WINCHESTER ROAD, A REQUEST BY COVENANT DEVELOPMENT TO AMEND THE CITY OF MURRIETA'S SPHERE OF INFLUENCE MAP TO INCLUDE THEIR 1.74 ACRE PROPERTY AND TO PRE-DESIGNATE THE SUBJECT PROPERTY WITH THE CITY'S COMMUNITY COMMERCIAL (CC) DESIGNATION

Recommended Action: That the City Council:

a)         Accept staff's environmental determination;

b)         Adopt a Resolution approving General Plan Amendment 03-223;

c)         Introduce an Ordinance approving Zone Change 03-222; and

d)         Approve Development Permit Plan 02-396 based on the Findings and subject to the Conditions of Approval.

 17.            APPEAL CASE #03-346 - APPEAL OF HEIGHT MODIFICATION (CASE #03-264) FOR 111 CONDOMINIUMS LOCATED ON THE SOUTHEASTERLY CORNER OF JUNIPER STREET AND ADAMS AVENUE

Recommended Action: Accept staff's environmental determination, Deny Appeal 03-346, and Uphold Planning Commission's approval for a height modification based on the Findings.

REPORTS, REQUESTS AND COMMUNICATIONS

 18.            ALLOCATION OF COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS

Recommended Action: Allocate available 2004-2005 Community Development Block Grant (CDBG) funds and authorize the Mayor to execute the Supplemental Agreement with the County of Riverside that allocates the funds.

*23.          ACCEPTANCE OF A PORTION OF LOT 1 OF TRACT 24159-1 AND A PORTION OF LOTS 61, 62, AND 65 OF TRACT 27348 FOR LANDSCAPE MAINTENANCE

Recommended Action: Accept the landscape improvements for a portion of Lot 1 of Tract 24159-1 and a Portion of Lots 61, 62, and 65 of Tract 27348 and direct the Murrieta Community Services District to commence maintenance of the landscape associated with these lots and recordation of appropriate documents.
