Recommended Action: Approve the 5% specialist pay according to the City Police Officers Association Memorandum of Understanding Section #19(B) effective July 1, 2003, for the qualified Computer Forensics Officer position now being developed.

*21.          SETTLEMENT AND RELEASE AGREEMENT WITH FIRST CLASS AUTO COLLISION, INC.

Recommended Action: Approve the Settlement and Release Agreement between the City of Murrieta First Class Auto Collision, Inc., agreeing to waive $18,126.60 in storm drain and major bridge Development Impact Fees.

*22.          AGREEMENT WITH PROPERTY OWNERS ON WASHINGTON AVENUE FOR SEWER AND WATER LATERALS

Recommended Action: Approve the form of the attached agreements for Sewer and Water Line Connection, Sewer Line Connection, or Water Line Connection between the City of Murrieta, Washington Avenue property owners and Murrieta County Water District; and authorize the City Manager to execute the individual agreements with property owners.

*23.          REDISTRIBUTION OF THE LOS ALAMOS HILLS CIP CONSTRUCTION CONTINGENCY (P600) FUNDING CURRENTLY RESERVED FOR AMERICAN CONTRACTING, INC., TO ENCOMPASS THE ADDITIONAL GRADING FOR THE PROPERTY RECENTLY ACQUIRED AT 37252 LOS ALAMOS ROAD

Recommended Action: Authorize staff to use and redistribute the Los Alamos Hills CIP Construction Contingency (P600) funding currently reserved for American Contracting, Inc. to encompass the additional grading for the property recently acquired at 37252 Los Alamos Road.

PUBLIC HEARINGS

 24.            ADOPTION OF THE WESTERN RIVERSIDE COUNTY MULTIPLE SPECIES HABITAT CONSERVATION PLAN (MSHCP)

Recommended Action: That the City Council:

a)         Adopt a Resolution making responsible agency findings, Approving the Multiple Species Habitat Conservation Plan and Authorizing execution of Implementing Agreement. 

b)         Introduce an Ordinance for Multiple Species Habitat Conservation Plan fees; and

c)         Adopt a Resolution establishing procedures and responsibilities for the fee program including recovery of City administrative costs.
